Welcome to SportArc. Before using the SportArc software and related services, please read and comply with these Terms of Use (the “Terms”). Please read all provisions carefully, especially provisions that may limit liability, affect your rights, or refer to separate terms for specific services. Unless you have read and accepted all provisions of these Terms, you may not use the SportArc software or related services. By tapping “Agree”, using the software, or otherwise indicating acceptance expressly or impliedly, you acknowledge that you have read and agreed to be bound by these Terms.
If you are a minor or have not reached the age of majority under the laws applicable to you, please read these Terms with your parent or legal guardian and pay special attention to provisions relating to minors.
These Terms are entered into between you and Rongchang District Sijin Software Development Studio (Individual Industrial and Commercial Household), the operating entity of the SportArc software, regarding your downloading, installation, use, copying of the software, and your use of SportArc-related services. “SportArc software” refers to the SportArc application software and related services developed, operated, and provided by Rongchang District Sijin Software Development Studio (Individual Industrial and Commercial Household) and any operating affiliates that may exist. “SportArc software user” refers to an individual or organization that registers, signs in, or uses the SportArc software and services. In these Terms, this is generally referred to as “you”. “End user” refers to an individual user who obtains the right to use the SportArc software through a SportArc software user. The above “SportArc software user” and “end user” are collectively referred to as “users” or “all users”. SportArc is intended for users outside mainland China.
These Terms are legal documents between you and SportArc regarding use of the software and services. These Terms also include related agreements, service terms, business rules, and other rules that SportArc may publish from time to time in connection with the Service. Once such content is officially published and notified to users, it becomes an integral part of these Terms and you should also comply with it. If there is any inconsistency between these Terms and the above content, these Terms prevail unless the separate terms expressly state otherwise for a specific service.
The Service refers to the intelligent sports analysis tool service provided by SportArc (the “Sports Analysis Tool Service”). Users may upload their own sports videos through the software. Artificial intelligence technology may analyze the videos and provide technical metrics, training suggestions, auto editing results, match review results, and other feedback (the “Service”). SportArc provides Free and Plus membership levels. Free users may use the Service with limited usage quotas. Plus users may pay subscription fees and receive higher or larger usage quotas according to the applicable membership service terms. If you purchase paid services, the applicable Membership Service Agreement and Auto-Renewal Service Rules also apply. SportArc does not provide user-generated content publishing or social networking features. Videos uploaded by users are used for personal technical analysis and related service purposes and are not publicly displayed by default. SportArc does not include a personalized recommendation algorithm feature that recommends customized content based on your personal characteristics.
SportArc provides AI-assisted sports analysis for training and informational purposes only. It is not medical advice, diagnosis, treatment, rehabilitation guidance, or a guarantee of athletic performance.
SportArc currently provides an iOS version. Users should download and install the software on iOS terminal devices. SportArc may enrich the ways and devices through which you use the Service in the future. If you have registered for and used one version of the software service, you may use the same account to sign in to and use other versions of the software service provided by SportArc. You understand and agree that these Terms automatically apply to all versions of SportArc software and services that you use.
You should obtain and download the software through Apple App Store. The software is only for use through versions obtained from lawful channels.
If you obtain the software or an installer with the same name as the software from a third party not officially authorized by SportArc, SportArc cannot guarantee that such software will function properly and is not responsible for losses caused thereby.
SportArc may develop different software versions for different terminal devices. You should select and install the appropriate version according to your actual device.
After downloading the installation program, you should follow the steps indicated by the program to install it correctly. The software may provide certain setting options during installation or use; please read them carefully and decide whether to agree.
To provide better and safer services, SportArc may recommend that you install other software or optional tools. You may choose whether to install them.
If you no longer need to use the software or need to install a new version, you may uninstall the installed software. Uninstalling the software may cause related services to become unavailable.
To improve user experience and service content, SportArc will continue to develop new services and may provide software updates from time to time. Updates may take the form of software replacement, modification, feature enhancement, version upgrade, or similar changes, including system upgrades or version changes.
To ensure the security and consistency of the software and services, SportArc may update the software or change or limit certain functions without separate notice to you. After an update, the interface or functions may change or be reduced. SportArc will make reasonable efforts to ensure that the updated software continues to provide its core service capabilities.
After a new version of the software is released, older versions may no longer be available. SportArc does not guarantee the continued availability of older versions. Please download and use the latest version in a timely manner.
You agree that SportArc may inform you of software updates through system announcements, in-app notices, update logs, or other reasonable methods, without notifying each user individually. It is your responsibility to keep informed of the latest version and updates of the software.
Protecting user personal information is a basic principle of SportArc. SportArc will take reasonable measures to protect your personal information, including information you provide during registration and use of the Service and videos you upload. Except as provided by applicable laws and regulations, SportArc will not disclose or provide your personal information to third parties without your permission. Details about personal information protection are set out in the Privacy Policy and other special rules.
When registering an account or using the Service, you may need to provide certain necessary information so that SportArc can provide services or improve your service experience. These situations include but are not limited to:
(1) performing user identity verification services, such as Sign in with Apple or other login methods made available in the App;
(2) performing software upgrade services;
(3) improving the security of your use of the software and related services;
(4) providing your information to relevant parties when required for specific features you use or specific services you request from SportArc or its partners;
(5) other information required by applicable laws, regulations, or policies.
In the above circumstances, if you refuse to provide relevant information, you may be unable to use the corresponding functions of the software.
In general, you may browse and modify information you have submitted. However, for reasons of security and identity verification, such as account verification or appeal handling, you may be unable to modify initial registration information or other verification information. SportArc will provide channels and methods for correcting and deleting personal information and closing accounts according to applicable legal requirements and the Privacy Policy.
Without your consent, SportArc will not disclose your personal information to any company, organization, or individual outside SportArc, except in circumstances permitted by applicable law, required by competent authorities, necessary to perform legal obligations or these Terms, necessary in an emergency to protect the personal safety, property safety, or other lawful rights and interests of you or others, where you have made the information public yourself, or in other circumstances where disclosure is lawfully permitted.
You should fully respect any personal information of others that you obtain through the Service. You may not collect, copy, store, disseminate, or use others’ personal information for any purpose without permission, otherwise you will bear the legal responsibility arising from such conduct.
Note: SportArc attaches great importance to the protection of minors’ personal information. SportArc will protect minors’ information security according to applicable requirements. Please refer to the Privacy Policy and other special rules for details.
7.1.1 The information content referred to in this section means any content created, copied, uploaded, published, transmitted, or otherwise made available by users when using the software and services, including account avatar, name, profile description, and other registration information, videos, images, and other content uploaded while using the software, and other content generated through use of the SportArc account or software and services.
7.1.2 You understand and agree that SportArc is committed to providing users with a lawful, healthy, orderly, and reliable service environment. You may not use a SportArc account or the software and services to create, copy, upload, publish, or transmit content that disrupts normal operation of the software or infringes the lawful rights and interests of other users or third parties, including but not limited to:
7.1.2.1 Content that violates applicable laws or is prohibited by law, including:
7.1.2.2 content that infringes others’ reputation, portrait rights, privacy, intellectual property, trade secrets, or other lawful rights;
7.1.2.3 content involving others’ privacy, personal information, or personal data;
7.1.2.4 harassing, advertising, excessive marketing, spam, or sexually suggestive content;
7.1.2.5 other content that violates applicable laws, public order and good morals, disrupts SportArc’s normal operation, or infringes the lawful rights and interests of other users or third parties.
7.2.1 Unless permitted by law or authorized in writing by SportArc, you may not engage in the following conduct while using the software:
7.2.1.1 delete copyright notices on the software or its copies;
7.2.1.2 reverse engineer, reverse assemble, decompile, or otherwise attempt to discover the source code of the software;
7.2.1.3 copy, modify, hook, run, or create derivative works based on content in which SportArc owns intellectual property rights, including by using plug-ins, add-ons, or unauthorized third-party tools or services to access the software or related systems;
7.2.1.4 copy, modify, add, delete, monitor, or otherwise affect the software, data released into terminal device memory while the software runs, or interaction data between the client and server;
7.2.1.5 modify or forge instructions or data during operation of the software, add, delete, or change software functions or effects, or operate or publicly disseminate software or methods used for the above purposes;
7.2.1.6 log in to or use SportArc software and services through unauthorized third-party software, plug-ins, add-ons, or systems, or create, publish, or disseminate such unauthorized third-party software, plug-ins, add-ons, or systems;
7.2.1.7 interfere with the software, its components, modules, or data by yourself or through others or third-party software;
7.2.1.8 engage in any other conduct not expressly authorized by SportArc.
7.2.2 You understand and agree that, based on user experience, software operation security, platform rule requirements, and healthy service development, SportArc has the right to choose the recipients of the Service, decide the function settings and scope of availability of the software, and decide the recipients and scope of data interfaces and related data disclosure. If any of the following circumstances exists, SportArc may suspend or terminate provision of the Service to you as appropriate, including but not limited to:
7.2.2.1 your conduct violates applicable laws, these Terms, or other SportArc management rules;
7.2.2.2 your conduct affects the service experience or normal operation of the software;
7.2.2.3 your continued use of the software presents security risks, including risks to personal or property safety of yourself or third parties, or risks to public safety.
Unless permitted by law or authorized in writing by SportArc, you may not engage in the following conduct while using the Service:
7.3.1 impersonate or use another person’s identity to use the Service;
7.3.2 induce other users to click links or share information;
7.3.3 fabricate facts or conceal the truth to mislead or deceive others;
7.3.4 infringe others’ reputation, portrait rights, intellectual property, trade secrets, or other lawful rights and interests;
7.3.5 use a SportArc account or the Service for commercial advertising or any form of promotion without written permission from SportArc;
7.3.6 use a SportArc account or the software and services to engage in any illegal or criminal activity;
7.3.7 create or publish methods or tools related to the above conduct, or operate or disseminate such methods or tools;
7.3.8 engage in any other conduct that violates applicable laws, infringes lawful rights and interests of other users, disrupts normal operation of the software, or is not expressly authorized by SportArc.
You fully understand and agree that you must be responsible for all conduct under your SportArc account, including content you upload and any consequences arising from it. You should independently judge content in the Service and bear all risks arising from use of the content, including risks arising from reliance on legality, accuracy, completeness, or usefulness. SportArc cannot and will not be liable for any losses or damages caused by the above risks, except to the extent required by applicable law.
If SportArc discovers or receives a report that you have violated these Terms, SportArc may delete or block relevant content without notice and, depending on the circumstances, take measures against the violating account, including warnings, restricting or prohibiting use of some or all functions, suspension, or account cancellation, and may announce the result of the handling. You understand and agree that SportArc may, based on reasonable judgment, take appropriate legal measures against conduct that violates applicable laws or these Terms, including reporting to competent authorities or pursuing legal liability. SportArc is not liable for losses resulting from such measures. If your violation of these Terms or related service terms causes SportArc to suffer losses, you should compensate SportArc and hold SportArc harmless to the extent permitted by law.
Your SportArc account is set up and maintained by you. SportArc recommends that you properly keep your account and credential information. If you discover unauthorized use of your account or any security vulnerability, you should notify SportArc immediately. You understand that SportArc needs reasonable time to act on your request, and before that, SportArc is not responsible for losses caused by third-party use of your account, except to the extent required by applicable law.
You understand and agree that, like most internet software, the software may be affected or interfered with by many factors, including user factors, network service quality, and social environment, and may also encounter security issues, such as others unlawfully using your information for harassment or other software you download containing viruses, trojans, or other malicious programs that threaten your terminal device information and data security and affect normal use of the software. Therefore, you should strengthen your awareness of information security and personal information protection and protect your credentials to avoid losses.
You may not create, publish, use, or disseminate malicious programs used to steal SportArc accounts, others’ personal information, or property.
Maintaining software security and normal use is a shared responsibility of SportArc and you. SportArc will adopt reasonable industry-standard measures to protect your terminal device information and data security, but you acknowledge and agree that, due to technical limitations, SportArc cannot provide an absolute guarantee.
In all circumstances, please carefully judge the authenticity of online information and be alert to scams carried out in the name of the software. Please do not trust any online request that asks you to provide property-related information or transfer money. Before any property-related operation, please verify the identity of the other party and strengthen personal information protection.
The software may use software or technology developed by third parties, including open-source code and publicly available third-party components (collectively, “Third-Party Software or Technology”), and such use has been lawfully authorized.
If the software uses Third-Party Software or Technology, SportArc will display relevant license agreements or other documents on relevant pages or as appendices to these Terms according to applicable rules or agreements. Such agreements or documents displayed in an appropriate manner are an integral part of these Terms and have the same legal effect. You should comply with these requirements; otherwise, relevant third parties or authorities may pursue legal responsibility against you and require SportArc to provide assistance. You should bear the legal responsibility arising therefrom.
Any dispute arising from the software’s use of Third-Party Software or Technology should be resolved by the relevant third party, and SportArc assumes no responsibility. SportArc does not provide customer support for Third-Party Software or Technology. If you need support, please contact the relevant third party.
SportArc owns complete intellectual property rights in the software and services, except for rights owned by users or third-party rights holders. Unless otherwise agreed, all copyrights, trademarks, patents, trade secrets, and other intellectual property rights in the software, as well as all information content related to the software, including text, images, audio, video, charts, interface design, layout framework, data, or electronic documents, are owned by SportArc or relevant rights holders and are protected by applicable laws and international treaties.
Without written permission from SportArc or relevant rights holders, you may not, for any commercial or non-commercial purpose, implement, use, transfer, or license any third party to implement, use, or transfer the above intellectual property rights. All rights not expressly granted in these Terms remain reserved by SportArc. You must separately obtain written permission from SportArc when exercising such rights.
Your use of the software is deemed to mean that you have read and agreed to be bound by these Terms. SportArc may modify these Terms when necessary. After changes to these Terms, SportArc will publish the latest version in an appropriate manner. If you continue using the software, you will be deemed to have accepted the modified Terms. If you do not accept the modified Terms, you should immediately stop using the software and related services.
You understand and agree that SportArc may, according to business development or technical upgrade needs, change, suspend, limit, or terminate part or all of the software service content at any time. SportArc does not need to bear responsibility to you or any third party for exercising the above rights, but will notify you of relevant changes in advance through announcements or other means where possible. If relevant changes materially affect your rights and interests, SportArc will make reasonable efforts to notify you through in-app notice, email, or other means. If you do not agree to such service changes, you should stop using the software; if you continue using it, you will be deemed to accept the changed services.
The operator of the SportArc software is Rongchang District Sijin Software Development Studio (Individual Industrial and Commercial Household). For SportArc, prices and currency information, where applicable, are shown through the App Store or the applicable storefront. Paid services may be subject to separate terms, including the Membership Service Agreement and Auto-Renewal Service Rules.
These Terms will be interpreted and applied in accordance with applicable law, without limiting any mandatory rights you may have under laws applicable to you. These Terms do not create a new overseas operating entity or designate a separate overseas court, arbitration institution, or legal representative.
If any dispute or controversy arises between you and SportArc in connection with these Terms, the parties should first seek to resolve it through friendly consultation. If consultation fails, the dispute shall be handled by a court or other dispute resolution body with proper jurisdiction under applicable law.
The headings of all provisions in these Terms are provided for reading convenience only and do not affect the meaning or interpretation of any provision.
If any provision of these Terms is invalid or unenforceable, it does not affect the validity of other provisions. The invalid or unenforceable provision will be interpreted in a manner permitted by law, and the remaining valid provisions will continue to bind the parties.
You understand and agree that, during performance of these Terms, if performance is impossible or cannot be performed as agreed due to force majeure events, including natural disasters, government actions, changes in laws or regulations, network failures, or similar events, SportArc does not bear liability for breach of contract. To the extent permitted by law, SportArc will notify you in a timely manner of circumstances where it cannot perform all or part of these Terms due to a force majeure event and will make reasonable efforts to reduce losses caused to you.
When registering as a SportArc software user and accepting the Service, you should provide true and valid contact information, including email address, telephone number, or other contact information where applicable. If your contact information changes, you have an obligation to update it in a timely manner. SportArc may send you notices when necessary based on the contact information you provide. For notices under these Terms, SportArc may deliver them through webpage announcements, in-app notices, email, SMS, or other reasonable methods. Any such notice method will be deemed delivered to the recipient.
